The location certificate is a document containing a report and a plan in which the land surveyor expresses a professionnal opinion of the current situation and condition of a landed property. It provides the health status of the property as far as the titles, cadastre and any legislations and regulations affecting it.
This certificate is required mainly for a real estate transaction and may also be needed by a creditor, a notary, a lawyer, a realtor, an evaluator or a municipality. It may be requested by both seller and buyer.
This is a private document, even confidential, and given to the customer and to the only designated stakeholders. Moreover, the location certificate is not meant to be used to establish property lines or undertaking work with regard to the latter. These actions rather refer to staking or layout operations.
The location certificate is governed by the Regulation respecting standards of practice for certificate of location of The Quebec Land Surveyors Order (L.R.Q., c. A-23, r.7.1).
